Terms of Sale and Website Use

1. Who can buy

You must be at least 18 years old, or have the consent of a parent or guardian, and be able to enter into a binding contract. If you buy for a company, you confirm you are authorised to do so.

2. What you are buying

You are buying a license to use the MotionTale desktop software, delivered as a license key. The license is a one-time purchase, not a subscription. Its scope is set out in the End User License Agreement.

Check the system requirements on this website before buying. MotionTale needs a supported computer and graphics hardware to run.

3. Price and payment

The price is shown on this website in US dollars. Any applicable VAT or sales tax is shown at checkout before you pay.

Payment is handled by Stripe. We do not receive or store your card details. Your purchase is also subject to Stripe's terms.

We may change the price at any time; a change does not affect purchases already completed.

4. Delivery

Your license key is shown on screen as soon as payment is confirmed, and sent to the email address you gave at checkout. The software is delivered by download.

5. Refunds and right of withdrawal

If MotionTale does not work for you, write to us within 14 days of purchase and we will refund the full price. We will then deactivate the license key.

If you are a consumer in the EEA or the UK, you may also have a statutory right to withdraw from a purchase of digital content within 14 days. The refund above is offered in addition to, and does not limit, your statutory rights.

To ask for a refund, email contact@pictorytale.com with the email address used at checkout. Refunds are paid to the original payment method.

6. License keys

Keep your license key private. A key may be active on up to two computers at a time. We may withdraw a key that has been refunded, charged back, shared publicly or obtained by fraud.

7. Using this website

You agree not to misuse this website, including by attempting to disrupt it, to access it by automated means at scale, to guess or test license keys, or to circumvent its security.

8. Intellectual property

This website, the MotionTale name and logo, and the software belong to PictoryTale AS or its licensors. Nothing in these Terms transfers ownership to you.

9. Disclaimer

This website is provided "as is". Demonstrations and processing times shown here come from specific test conditions; your results will vary with your footage and hardware.

Nothing in these Terms excludes or limits rights you have as a consumer under mandatory Norwegian or EEA law.

10. Limitation of liability

To the maximum extent permitted by law, PictoryTale's total liability arising from these Terms or your purchase is limited to the amount you paid for your license. PictoryTale is not liable for indirect or consequential loss. These limits do not apply to liability that cannot be limited under mandatory law, including for intent or gross negligence.

11. Governing law and disputes

These Terms are governed by Norwegian law. Disputes are to be resolved by the Norwegian courts, with Agder District Court as agreed venue. If you are a consumer, you keep the protection of the mandatory laws of your country of residence. Consumers in the EEA may also use the European Commission's online dispute resolution platform, and consumers in Norway may contact Forbrukertilsynet.

12. Changes and contact

We may update these Terms. The version in force when you make a purchase applies to that purchase.
