End User License Agreement

1. What the Software does

MotionTale analyses a video of a person and produces a 3D character animation: a Blender scene, a motion file and an optional rendered preview. Processing takes place on your own computer.

Results are estimates produced by machine-learning models. They may be inaccurate or incomplete, and they are not suitable for medical, biomechanical, safety or forensic purposes.

2. Your license

When you buy a license, we grant you a non-exclusive, non-transferable license to install and use the version of the Software you purchased, for as long as you comply with this Agreement.

• One license key may be active on up to two computers at a time, for use by one person.
• You may move the license to another computer by deactivating one first.
• A company buying for several people needs one license per person.
• The license is for the Software as delivered. We may offer updates, but we are not obliged to.

The Software is licensed, not sold. PictoryTale and its licensors keep all rights not expressly granted here.

3. What you may not do

• Share, sell, rent, lend or sublicense the Software or your license key
• Remove, bypass or tamper with license activation or other technical protections
• Reverse engineer, decompile or disassemble the Software, except where mandatory law allows it
• Offer the Software to others as a hosted or paid processing service
• Use the Software in violation of any law or of another person's rights

4. Your videos and your results

You keep all rights in the videos you process and in the animations the Software produces from them. You may use those animations commercially.

You are responsible for the videos you process. Only use footage you have the right to use, and make sure the people shown have agreed where the law requires it. Motion derived from a person's performance can be protected by privacy, image or performers' rights.

Your videos and results stay on your computer. We do not receive them. See our Privacy Policy for the limited data sent during activation.

5. Bundled character and third-party components

The Software includes the Snow character, © Blender Foundation (studio.blender.org), licensed under CC BY 4.0. If you publish images or video that show Snow, credit the Blender Foundation as that license requires.

The Software uses third-party software and machine-learning models, including Blender, FFmpeg and others, each under its own license. Those licenses are listed in the notices delivered with the Software, and they govern those components. Nothing in this Agreement limits rights you have under them.

6. Activation

The Software must be activated with a valid license key. Activation sends the key, a computer code and the Software version to our server once; afterwards the Software works without an internet connection. A computer without internet can be activated through our website.

We may refuse or withdraw activation for a key that was refunded, charged back, shared, or obtained by fraud.

7. Updates and support

We may release updates and fixes. Updates are covered by this Agreement unless they come with different terms. We provide support by email on a reasonable-efforts basis and do not guarantee response times.

8. Ownership and feedback

The Software, its design, documentation and branding belong to PictoryTale AS or its licensors and are protected by Norwegian, EEA and international intellectual property law.

If you send us suggestions or feedback, we may use them without restriction or payment.

9. No warranty

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. We do not warrant that the Software will run on every computer, be error-free, or produce results that meet your needs.

Nothing in this Agreement excludes or limits rights you have as a consumer under mandatory Norwegian or EEA law.

10. Limitation of liability

To the maximum extent permitted by law, PictoryTale's total liability arising from the Software or this Agreement is limited to the amount you paid for your license.

PictoryTale is not liable for indirect or consequential loss, including lost profits, lost data, or loss arising from reliance on the Software's results.

These limits do not apply to liability that cannot be limited under mandatory law, including liability for intent or gross negligence under Norwegian law.

11. Termination

This Agreement lasts until terminated. You may end it at any time by uninstalling the Software. It ends automatically if you materially breach it; you must then stop using and uninstall the Software. Sections that by their nature should survive, including ownership, disclaimers and liability limits, continue to apply.

12. Export and lawful use

You may not use or export the Software in breach of applicable export-control or sanctions laws.

13. Governing law and disputes

This Agreement is governed by Norwegian law, without regard to conflict-of-law rules. Disputes are to be resolved by the Norwegian courts, with Agder District Court as agreed venue. If you are a consumer, you keep the protection of the mandatory laws of your country of residence and may bring proceedings there.

14. Changes and contact

We may update this Agreement for future versions of the Software. The version that applied when you bought or last updated the Software continues to apply to that version.
